PARKS AND RECREATION AREAS

 ARTICLE I - Riverfront Parking Areas [Adopted 6‑1‑1993]

 

~ 77‑1. Intent; purpose.

 

A.         It is the intent of this article to provide a framework to enable the Henniker Civic Association and the Town of Henniker to establish rules governing the parking of vehicles within the Riverfront Parking Area and a means of enforcing them.

 

B.         In addition, this article seeks to achieve the goals of the 1986 Community Development Block Grant which sought to find "ways to relieve congestion in the downtown area and to provide safer access for pedestrians and vehicles while preserving the unique character" of Henniker.

 

 

~ 77‑2. Traffic flow.

 

A.         Access is by one‑way entrance and exit.

 

1.    In: southerly most driveway (nearest river).

2.    Out: northerly most driveway (nearest square).

 

            B.         Safe public pedestrian, automobile and emergency vehicle access shall be maintained at all times.

 

1.    Pedestrianways shall be clearly marked.

2.    Traffic flow shall not be blocked by illegally parked vehicles.

3.    Traffic flow onto State Highway 114 shall not be blocked by loading or unloading vehicles.

 

C.        Parking spaces shall be clearly marked by the Town Highway Department.

 

D.        Any change in the parking layout shall be in consultation and by agreement between the Henniker Civic Association and the Board of Selectmen and adopted by the Board of Selectmen after agreement has been reached.

 

E.            No camping or motor homes or buses are allowed to park in this area.

 

 

F.            No parking spaces shall be blocked by other vehicles.

 

G.        No parking spaces shall be occupied by dumpsters or nonvehicles.

 

H.        Any unregistered vehicles shall be towed at owner's expense.

 

I.          Vehicles blocking or parked in the entrance or exit of State Highway 114 may be towed at owner's expense.

 

J.         These regulations shall be enforced by the Town of Henniker.

 

 

~ 77‑3. Overnight parking.

 

A.         Overnight parking 2:00 a.m. to 5:00 a.m. shall be allowed by displayed permits only; vehicles without permits will be ticketed/towed at owner's expense.

 

B.         Permits shall be issued by the Henniker Police Department upon written evidence from the property owners that a vehicle has been approved for overnight parking privileges.

 

C.        Landlords will be afforded permits based upon the number of spaces owned. In the event that an owner needs additional spaces, s/he shall negotiate with other landlords for procurement of space and permit. Landlords shall notify the Police Department, in writing, of said transfer.

 

D.        Business hours are defined as 8:00 a.m. to 6:00 p.m., Monday through Friday. Businesses may allow parking within loading zones during nonbusiness hours and shall designate the same with proper signage.

 

E.         All permits shall be good for parking in any parking space.

 

F.         Landlords will be presented a limited number of Visitor Passes to be available to tenants' guests or guests of the landlords which shall be displayed in visiting vehicles to permit overnight parking. Visitor passes will display expiration date when provided to guests.

 

 

~ 77‑4. Commercial loading zone.

 

A.         Loading or unloading of any materials(s) to commercial establishments shall be done from a designated loading zone.

 

B.         Loading zones shall be kept open during business hours. Business hours are defined as 8:00 a.m. to 6:00 p.m., Monday through Friday.

 

C.        Vehicles parked in loading zones during business hours may be towed at owner's expense.

 

D.        Dumpsters shall not be allowed in loading zones.

 

F.            All plans and designs for the implementation of loading zones shall be defined by  the Henniker Civic Association and approved by the Board of Selectmen by ordinance.

 

 

~ 77‑5. Maintenance.

 

A.         Snow removal shall be the responsibility of the Town of Henniker. Arrangements

 

            between the building owners, tenants and Town of Henniker shall be established in order to facilitate complete snow removal and cleanup.

 

B.         Clearing snow from the common staircase shall be the responsibility of the Town of Henniker.

 

C.        Clearing snow from private staircases shall be the responsibility of the property owners.

 

D.        Lights shall be maintained by the Town of Henniker.

 

E.         Tree pruning, planting and/or removal of trees in the parking area shall be the shared responsibility of all parties to this agreement. Individual landowners shall be responsible for trees on their properties.

 

F.         Spring and general cleanup shall be the owners' responsibility.

 

G.        Trash removal.

 

1.    Dumpsters shall be kept out of loading zones.

2.    Dumpsters and surrounding area shall be kept clean by owner.

3.    Dumpsters shall not block flow of traffic.

4.    Dumpsters shall be emptied regularly.

5.    Dumpsters shall be kept covered.

6.    Dumpsters shall be odor free and not leak.

7.    Dumpsters may be banned from the town easement area.

 

 

~ 77‑6. Enforcement. 

Enforcement of these regulations shall be the responsibility of the Town of Henniker Police Department. Any person, firm or corporation who shall fail to comply with the conditions enumerated above shall be guilty of a violation.

 

~ 77‑7. Future plans.

 

A.     This article shall be considered amended only after consultation between the Town of Henniker and the Henniker Civic

         Association and adoption by the Board of Selectmen after agreement has been reached.

 

B.     Failure of either party to respond within 30 days to a request for amendment shall constitute approval of the proposed

         amendment. 

 C.       If the Henniker Civic Association shall fail to exist, the rights and responsibilities accorded to the Association by

           this article shall revert to the landowners of the affected area.

 

D.      Riverfront enhancement shall be encouraged.

 

 

E.     Commercial uses of riverfront are acceptable, provided that:

 

1.    Land is owned by applicant.

2.    Town Zoning Ordinances are adhered to.

 

ARTICLE 2 - Smoking at Ball Field  [Adopted 12-7-2010]

~ 77‑8. Smoking at Town Hall Ball Field Smoking is prohibited on the grounds of the Town Hall ball field during times when an organized activity is taking place.  The perimeter falls within Depot Hill Road and Circle Street only.
