ANIMALS

ARTICLE I - Dogs and Other Animals 1 [Adopted 12‑12‑1989; amended 7‑31‑1990; 9‑4‑1990]
~ 11‑1. Disposal of dogs found running at large.
Any dogs found running at large, without having attached to the same either the license or the owner's name and address, shall be disposed of.
~ 11‑2. Dogs causing nuisances.
A. No dog, whether licensed or unlicensed, shall run at large or in any other way make a nuisance of itself within the limits of the Town of Henniker.
B. The term "nuisance," as herein used, shall be considered to be as defined in New Hampshire Revised Statutes Annotated 466:31, II.
C. Any dog who is found to be running at large or to be causing a nuisance in violation of this article may, at the discretion of the Police Chief of the Town of Henniker, be impounded or otherwise restrained at the expense of the owner.
~ 11‑3. Animals in parks and swimming areas.
A. Dogs and other animals shall be kept on a leash at all times while in any park or swimming area in the Town of Henniker.
B. Dogs and other animals shall not be allowed on a public beach or in public swimming areas.
C. Dogs and other animals shall not be allowed to deposit feces in areas used continually by people, such as picnic areas, playground areas, parking areas, sports fields, walking areas, etc.
D. If a dog or other animal becomes objectionable, its owner shall be required to remove it.
~ 11‑4. Violations and penalties.
A. Any person who shall be found in violation of any provision of this article shall be fined or summoned
in accordance with this schedule:
1. First offense: $35.
2. Second offense: $75.
3. Third offense: This offense and any subsequent offenses thereafter, will result in a court summons
which will require the violator to appear before the Henniker District Court. Any person found
guilty of a third or subsequent offense may be fined up to $500.
B. First and second offense fines are payable only to the Town Clerk of Henniker, New Hampshire.
